International Legal and Ethical Issues

International and legal issues surround any business that operates in another country. Dealing with international legal issues entails an understanding of the law and international policies, cultures, and politics. There are several legal issues involved in settling legal disputes within international transactions. In the simulation CadMex created an agreement in the form of a contract for the international sale of goods. In the agreement the international sale of goods covers the service provided to the other company. The contact also entails training of the staff on applicable technical assistance. Contracts are established to protect both parties. I think contracts are the most common when handling international legal and ethical issues because you have an agreement to refer to.

One of the considerations of taking legal actions with business in a foreign country is a person or business will know the laws in other countries. If you know the laws, you will know if you can take legal action with a business in another country. Another consideration is forming a contract with the foreign country before doing business. In addition, a business based in the United States should know if it is legal to serve a business in a foreign country. These considerations are based on establishing a relationship in other countries and knowing their laws. In addition, a company should review the economy. It can get rather expense taking legal action in another country.

I believe a factor that can potentially stand against CadMex’s decision to allow sublicensing is not having everything in writing in the agreement. Sublicensing agreements purpose is to give some rights to a product without handing over all rights. It may give permission to use their trademark but within the limits of the sublicensing agreement.
