Discriminatory hiring is the process that an employer select his candidate base on criteria rather than the applicant qualification. Thus discrimination is prohibited based on sex, race, religion age, national origin, skin colour and disability. Although some state do not implement this law on small company, however, they can still sue the company for not hiring them base on unfair employment practices. Therefore, company should conduct a fair hiring process. This will not only protect them from claims of discrimination it will also ensure them that they have choose the right person for the job.

There are a few reason that discriminatory hiring practice still exist. Which is national origin, race, and gender.

As some employer will reject applicant due to their birth place because of their speaking accent or their last name. Example like if Asian wanted to work in a company, he or she may not be hire because of the Asian accent as he or she think that it is not a clear oral and is afraid of customer not understanding his Asian accent.

Another would be race, as some employer do have racial discrimination against some race because of the image that the race produce. Example will be like in the states, employer refuse to hire Latinos, some employer will only promote the white employee to a management rank and some will request African-America to have a drug test.

Gender discrimination normally occurs with women when hiring. As come employer believe that women lack the skill and qualification to perform better than men’s. Furthermore , women tends to get pregnant after marriage and they will not be able to work for a long period of time thus employer do not want to waste their time on training a women and have to hire another person to temporary take over her work because of her pregnancy.

These are just some justifiable reason for discriminatory hiring, I believe there are more than this. Despite the law implemented, there are still many employer...
