The tort actions that occurred in Scenario 4 are: intentional, negligent and strict liability. These torts were also criminal based because of the harm that was done from one person to another. Lee has opened fire on innocent customers and the security guard takes his frustration out on Lee after Randy has knocked him unconscious. The potential plaintiffs in this scenario would be the lady that was shot, her husband that had a heart attack and the young boy that was injured from the ricochet bullet. Lee might could be a possible plaintiff in this case, because of the injuries that he suffered from the security guard and from Randy. The tort claim that would be filed against Lee states that tort laws require individuals to act responsibly and reasonably even though that may not happen. The defendants in this case would be Buy-Mart because they are responsible for ensuring the safety of their customers. Randy would also be a defendant since he left Lee unattended with a gun and bullets. The security guard also because he inappropriately handled the situation with Lee. Lee would also be a defendant because of his criminal act of shooting the gun. I think that Buy-Mart would argue that they had no idea of Lee’s intentions and they should not be held accountable for his actions. Randy would argue that he was not properly trained by Buy-Mart on how to process the sale of guns and that he did not know that he should have turned his back on a customer. The security guard would argue that he was just ensuring the safety of the customers and that he wanted to make sure that Lee did not come to and do any more harm. I think that Lee would be held accountable for his actions in a criminal suit from the husband, wife and boy. If Lee had prior criminal background then he would most likely go to prison because he had no defense to what caused his attack.
