The simulation of International legal and ethical issues help in understanding that setting up and managing international business is full of challenges. An important example is contract terms. Contract terms must be defined explicitly to avoid some major legal and ethical issues. Legal issues that could arise when dealing with International business are political situations and international laws. Some cultural issues can effect business disputes on an international level.

Issues involved in resolving legal disputes can be selecting proper counsel, understanding foreign laws, due diligence, and choosing the right law and dispute resolutions. Companies that enter into a contract with another country should confirm that the contract is legal and enforceable. Each country should be aware of any international laws and legislations.

Business’ needs to consider the laws of the country they are thinking of doing business in.  A U.S Company has to remember, a law in the U.S. is not the same law in another country. Should a law be broken, it may not be enforceable in another country as it can be enforced in the U.S. Even though, a contract is binding agreement, it is only binding if the law agrees.

Factors that could work against CadMex’s decision to grant sublicensing include the time and cost increases as well as price differences between generic brands. Local customs and laws can conflict and there will need to be set ways on how to deal with these situations. Domestic law has nothing to do with international law and businesses should be prepared to face any issues that arise.

Compared to the week one readings, this simulation provided more detailed information as to how and why certain resolution methods are the best to choose. In week one there was discussion of companies that had negative results when going into legal disputes which...
