This paper will discuss a Business Ethics case. There will be some discussion of the parties are that are involved. The facts of the case will be given. Jurisdiction will be sited to show just exactly where the case was heard and why it was heard there. After reading this paper there should be a greater understanding of this particular case and also some understanding of business law.
First, there is the identification of both parties involved in the lawsuit. The defendants in the case are the National Enquirer Corporation and the president of the National Enquirer. The National Enquirer is a national weekly newspaper. The Enquirer is a Florida based corporation, along with President Calder’s main residence in Florida. The National Enquirer has a total of over 5 million copies printed into circulation. California has the most printed circulation with six hundred thousand copies. This margin is more than double of the next state’s amount of circulation. The plaintiffs in the case are Shirley Jones and her husband, Shirley Jones lives and works in California. She is a professional entertainer and television star whose career has mostly taken place in California. Jones is well known there.
The suit was brought about because of an article that was written by South, an employee for the National Enquirer. The suit alleges that the article caused defamation, invasion of privacy, and intentional infliction of emotional distress. The article is alleged to have caused so much damage because of the negativity, defamation of character, toward Jones that she can no longer work. She has not been able to get gainful employment because of the article and this caused emotional distress. Her career as an entertainer is proposed to have been tainted, especially in California.
