Companies as large as Alumina Incorporated have certain strong inherent environmental risks associated with them. The possibility for EPA violations due to the nature of the materials they deal in is very high. For these reasons, it is very important to have an effective plan to deal with these types of problems as they are sure to arise. Historically, when cases have been brought against large companies like Alumina Incorporated, those cases have resulted in millions of dollars being paid out in claims and court costs. Most times the catalysts for these types of cases are rooted in environmental violations that caused subsequent adverse impacts on a person’s health or someone’s property. In some cases the result may have even been death. It is common for the type of claim brought against a company such as Alumina Inc. to be classified as an unintentional tort. This also means that the company was negligent. There are corrective measures a company can take to effectively manage certain regulatory issues associated with the business they deal in.

When associated with a company that has such strong potential for environmental impact, it is understood that at some point the company will likely incur an EPA violation. Furthermore, the strong possibility exists for valid claim to be brought against the company (due to the EPA violation) that something the company has done inadvertently affected someone or something adversely. The first step in addressing the problem would be to correct whatever the EPA violation is. This can be done by consulting the EPA guidelines to ensure the company is in compliance with the standards that have been set in that particular area. Secondly, in dealing with the legal fall out associated with the violation, the company should first seek mediation as an alternative to litigation.
