Describe the elements of Affirmative Action as it applies to public sector and private sector employees, and how it interacts with Title VII requirements of Equal employment Opportunity.
Title VII is one section of the Civil Rights Act of 1964 that prohibits employers from discriminating on the basis of race, sex, color, religion, or national origin. However, for each of these discriminations, cases are tried on an individual basis. It is up to the employer to uphold Title VII regulations.
Equal Employment Opportunity (EEO) is a term used by the federal government to refer to employment practices that ensure nondiscrimination on the basis of race, sex, religion, color, national origin, physical or mental ability, medical condition, ancestry or age. The principal behind EEO is that everyone should have the same access to opportunities. EEO is legally mandated for all federal contractors and subcontractors.
Affirmative Action is one aspect of the federal government’s efforts to ensure equal employment opportunity. The purpose of affirmative action programs is to promote fairness (equal opportunity) and address the effects of past discrimination in employment by encouraging targeted outreach efforts to attract underutilized minorities and women. (Bennett-Alexander and Hartman, 2007).
a) What employers are subject to affirmative action plans and why?
Public and private institutions are subject to Affirmative Action (over 15 employees).
Government contractors and sub-contractors are subject to Affirmative Action plans.
For federal contractors and sub-contractors, Affirmative Action must be taken by covered employers to recruit and advance qualified minorities, women, persons with disabilities and covered veterans.
