Analysis: Issues
There are many factors surrounding this protest of award from FSI. The protest is based on the procurement not being set-aside for small business under the Federal Supply Schedule. Specifically FSI protest is for “sources sought” and “improper bundling”. FSI protest that the agency unreasonably and unfairly evaluated the response to “sources sought” notice to small business FSS vendors to ascertain their capability of meeting the agency’s requirements, which is denied by the GAO. The protester does not rebut this but, argues that it was treated “disparately” from other vendors who were solicited to submit quotations for the services. According to the agency the protester was on the “footing” completely different from the other vendors solicited, and its response did not have to be considered in the same way as the other quotations because it was solicited for a different purpose.
Synthesis: Agree/Disagree
I disagree with FSI protest based on several incomplete actions that were necessary in-order to
be considered for award as the best value resulting in the lowest overall cost alternative to the
Government. FSI did not present this case with enough supporting facts. Based on the solicitation
requirements FSI has not corrected the deficiencies in the proposal by not showing a tracking record for
recycling program detailing a plan of action, not providing adequate details on how many “green”
products were offered on-line that met the EPA’s EPP criteria, address its knowledge on environmental
capabilities did not have the correct information in EPA’s paper requirements. FSI failed to mention a
commitment by the firm to the development and utilization of “green” delivery vehicles and fleet
maintenance programs, a training module, nor the firm’s implementation of “Environmental
