Saving a Child Ethically

For this ethics paper I chose to discuss the situation in reference to the dilemma that took place in choice two. A married couple who were both obviously addicted to drugs, and were knowledgeable to the fact that they were unable to meet the needs of their infant daughter. She was soon taken from them by court order and placed in foster care later on to be united with a foster family. Years pass, and she soon comes to regard the foster parents as her real biological parents. The parents love the foster child as their own and treats her as such. Soon the child becomes nine years of age, the natural birth parents rehabilitated from drugs, begins court action to hopefully regain custody of their daughter. The case goes to trial and the judge rules in the favor of the biological parents. The child is then returned to the biological parents against her will. Does ethics support the law in this case?

In this I decided to go about answering this in terms of what what should of happen in regards to this case to what actually happen. In this I choose to go with Care-Based and Ends-Based. In this decision I feel as though Care-based ethics supported the law in this case, but only in the the favor of the biological parents. I came to believe this because many people very empathetic, and I have personally crossed paths with people who has had their children taken away due to certain circumstances such as this. Drugs being the number one thing. Some were fortunate enough to get their children back but others on the other hand were not. But as a parent, I can defiantly imagine what they were going through from the sadness to the guilt and also the helplessness these parents had to go through.
