Advocacy for Individuals Wrongfully Arrested Domestic Violence

Abstract

The victims of domestic violence sometimes get arrested, when this occurs that individual can be traumatized psychologically, more so than the other individual involved in the domestic violence occurrence. These individuals require support from an advocate. Above the suffering of the domestic violence itself, the unfairness of a wrongful arrest is excruciating to that individual. Worse yet, when the individual has kids, the individual is regularly deeply terrified that the executor of the violence will use the wrongful arrest against them in attaining custody of the kids. Regrettably, the individual is time and again correct. Overall, a domestic violence victim, when wrongfully arrested, is habitually so broken mentally they are not capable to focus on the steps required to save themselves.

Steps Towards Advocacy for the Client

Counsel the client not to talk to the law enforcement. The initial intuition of domestic violence victims whom are under arrest is to go freely talk to law enforcement. The client may feel that if the arresting officer will hear the truth, that somehow the arresting officer(s) will forgo the arrest. This is enormously naive intuition, most times once a individual is branded a suspect, everything they say can and usually is will be used against them in court.

Straightaway, take photographs any injuries, even when the individual conveys that law enforcement has taken pictures. Persistently, once law enforcement decide to arrest the individual, these same officers of the law fail to take care in collecting facts that may well refute the client's guilt. Taking photos is a main concern since the majority injury can often swiftly fade away.
