In the event a conflict arises that cannot be solved regarding team participation, contributions to or late assignments, quality of work or anything else that may hinder the team’s dynamic and success, the Alternative Dispute Resolution (ADR) will be used. The ADR is only to be used when all other means of conflict resolution have been exhausted, and the conflict has not been solved for 48 hours.

Once it is established that the implementation of the ADR clause is necessary, the team will ask the instructor to appoint a mediator to assist the resolution of the conflict. The instructor may choose a student from the current class, who is not on the same learning team, or a student of another course that the instructor teaches. The selection of an outside mediator will guarantee neutrality. Within 24 hours of choosing the mediator, a conference call will take place where the mediator will foster conversation and encourage resolution although he or she cannot force it. The mediator cannot render a binding decision. If the involved parties come to a resolution, it will be documented and posted in the team forum for other team members to see and for future reference in case the same conflict occurs again.

If however, a solution has not been found, the parties will ask the instructor to arbitrate. Another conference call will take place within 24 hours of the mediating conference call where the instructor will hear both sides and render a binding decision. This decision is final and cannot be appealed. The decision will be documented and posted in the team forum. Adherence to the decision is mandatory.
