In favour or against the same rights for homosexuals and heterosexuals ?

I agree with the fact that homosexuals must be respected as any other human beings but what was considered until 1993 as a illness by the WHO (World Health Organisation), should not be considered as the standard and should not be encouraged.

Of course, I do not deny anybody the right to enter into a contract with a person of the same sex in order to enjoy a certain stability and maybe financial benefits (in fiscal and inheritance matters) but I deny homosexuals the possibility of getting the same rights in marriage and adoption matters.

Why ?

1. First, I’ll expose some juridical arguments.

In the first article of the Declaration of Human Rights, of 1789, one can read: «All men are born free and equal in rights ». But it is made clear in the next sentence, that « the social distinctions can only be based on common utility. » The couple man-woman permitting the perpetuation of the Nation, it seems legitimate to grant him a special status.

The homosexuals want equality before the law, claiming their right to get married. But the marriage is not a law, it’s an institution, which is considered by the State as being useful at their stability and continuity. Furthermore, the equality of rights is valid for persons of a same category, but homosexuals are different from heterosexuals, so their request is unjustified.

What‘s more, the French Civil Code defines the marriage as a union between a man and a woman and, on the 26. February 2002, the European Court of Human Rights has recognized France’s right to refuse the adoption of children to homosexuals.

2. Now, let’s come to the problems which could emerge from the permission given to the homosexuals to adopt children.

- In the best case, one member of the couple is the biological parent of the child.
