Disability Discrimination is to discriminate based on someone’s handicaps. So in 1990 The Americans Disability Act was signed into law on July 26, 1990 by President George W. Bush and later in 2009 the law was amended with changes (WikiPedia). In this paper I will give a description of a disability discrimination violation that had led to a lawsuit and give the results based on the court decision and what the company had to do in order to rectify the problem. Also there will be a brief description of the EEOC and what role they played in the situation. Thirdly whether or not the lawsuit promotes social change and give my reason based on what I believe. Then I will give a comparison of the EEOC press release and if it differs from the original news report of the incident. Lastly if I was the active senior manager of this company what would I do to ensure future compliance and inclusion in the multicultural workplace?

In August of 2007 ENGlobal hired Jeff Rose as a safety supervisor. After he started his job, Jeff Rose began to notice some numbness and tingling in his fingers and after reporting this to the regional supervisor who was a part time paramedic advised Jeff Rose to go to the doctor and take a medical leave from work because the regional supervisor felt the company itself did not want to deal with his debilitating disease. After following the regional supervisor advised Jeff Rose left work and went to the doctor. After getting tests results back and finding out he did not have a debilitating disease that prevented him from working he took the paper work to the company and they refused hiring Jeff Rose back even though there was a vacancy for his job for two weeks after submitting his doctor’s findings.
