Case Study: Employee’s dismissal Case

Executive Summary

The attached case discusses the interaction and reactions of the different parties namely, the employer, the employee and the Trade union representing the employee.

The Labour Relations Act, No. 66 of 1996 has an extended amount of guidelines and rules, for the employee, employer and Trade Unions to follow.

Unfortunately, the case has only indicated that the employer or union applied none of the abundance of guidelines and rules in the Act. The referred case is a brutal example what happens when decision making is irrational and based on emotion instead of logic, reason and the appropriate legislation. This seems to include Senior Management (sarcastically reported incident).

This in turn has created a lot of additional work and can even indicate a trend line in the current business as it is currently dealing with...
