Alternative Dispute Resolution

Working in a learning team can be a positive learning experience if each team member is in agreement with the guidelines set forth in the Learning Team Charter. The Learning Team Charter provides a description of each member skills, learning team goals, and ground rules. In the event that a disagreement rises an alternative dispute resolution (ADR) (Cheeseman, 2010, p. 43) has been put in place to diffuse a possible disagreement situation.

The ADR elected is negotiation it is a procedure to whereby the parties to a dispute engage in negotiations to try to reach a voluntary settlement of their dispute (Cheeseman, 2010, p. 44). In order for this ADR to work efficiently it will be applied to any disputes and disagreement all team members may reach. Negotiations maybe initiated by one or more team members speaking out and informing the team he or she believes a possible disagreement has been reached.

Negotiations will be held at neutral locations example of this is University of Phoenix Campus learning team rooms. The team will meet to present offers, and counter offers to each other. Each team member has agreed to reach a settlement agreement, an agreement voluntary entered into by the two parties to settle a dispute (Cheeseman, 2010, p. 44) within 48 hours after the face- to- face negotiations begin.

Choosing to have Negotiation as the ADR will ensure the learning team has preventative measures in place in case of disagreement. Thinking ahead and creating this plan will save the learning team possible disruption and loss of time and team members.
