Chapter I

The Problem and Its Setting

Introduction

Homosexuals are considered to be one of the most oppressed group people in our society. They are treated as inferior people because they are part of the third sex. They are not treated as normal beings because of their indescribable personality and usually lewd acts. Most of the people are not aware that they are already stepping on their rights and they are inflicting moral damages to them. The rights that they are deprived of are not only pertaining to social standards but even constitutional rights.

Statement of the Problem

How are homosexuals discriminated by the society in the social and moral aspect and in terms of their rights?

1. What rights have Filipino homosexuals been deprived of?

2. How can homosexuals in the US and in the Philippines are compared in terms of:

a. Response of the government to the struggle made by the homosexuals

b. Beliefs of the church

3. What are the hindrances that prevent the implementation of special laws to protect the rights of the homosexuals?

Statement of the Hypotheses

Laws must be implemented equally for the protection of every citizen of the state. Homosexuals are not given such equal treatment. There are lots of discriminatory acts of the society that secludes the members of the third sex on the enjoyment of rights. The wrong perception of the society towards the homosexual makes them categorize such group of people to an inferior position. There must be implementations of new laws that could address such problem of our present society.

Assumptions of the Study

• Homosexual are discriminated, consciously or unconsciously.

• The current Philippine legal system lacks laws to prevent or at least minimize such discrimination.

• Implementation of special laws would be effective just as much as it has been effective to other countries who have implemented such kinds of laws.
