Supreme Court of Appeal

With our attention focused to our country South Africa, our court sit in Bloemfontein. And this is the highest court of the land, which means its decisions are binding on all other courts. The supreme court of appeal serves as a court of appeal for the provincial and local divisions of the high court. It has jurisdiction over the whole country and the chief officer is the Chief Justice.

High Court

The high court is comprised of two divisions, which are the Provincial Divisions and Local Divisions. The provincial and local divisions of the high court differ from the lower courts in that they have power to make orders that are unlimited as to the sum of money involved or the type of action to be taken. They also hear appeals from decisions made in Magistrate’s courts. Their jurisdiction is limited geographically and their power may also be curbed by parliament.

A provincial division is headed by a Judge President and together with ordinary judges they are addressed as My Lord. The registrar of the court and the sheriff are responsible for the admin duties and delivery processes.

Magistrate Court

The magistrate is the one who is a presiding officer and he is referred to as Your Worship. They are public servants and the admin duties of this court are handled by the clerk of the court and all processes are delivered by the Deputy Sheriff. This is the lower court and their jurisdiction are restricted in terms of sentences or fines that it may impose, as well as the value of actions brought before it.
