Making sure that the frequent shopper program is unbiased based on race, religion, or geographical location is another goal that the frequent shopper program needs to address. Even though according to Kudler Fine Foods they are trying to stay away from using price as a differentiation factor like lower end markets (Apollo Group, Inc, 2012). This could send the wrong message to customers who live in poorer areas but still want to be members of the frequent shopper program. Other legal issues that Kudler Fine Foods may face include theft of information by employees or others, improper use of information by partners in the frequent shopper program. The use of the information that Kudler Fine Foods gathers from its customers who use the frequent shopper program needs to be included in any negotiation of gifts with other third party companies and how they intend to use any information that Kudler Fine Foods would pass on to them. The information that Kudler Fine Foods passes on to third party companies should be included in the disclosure statement that Kudler Fine Foods has members of the frequent shopper program agree to and sign.
