Interstate commerce is commerce that moves between states or that affects commerce between states, (Cheeseman, 2010). A recent statute passed by the state of Confusion causes issues and challenges for out-of-state trucking companies wishing to use the highway running through the state of Confusion. This statute increases the economy of the state yet incurs added expenses for out of state trucking companies obligated to install a b-type hitch only manufactured in Confusion. The enforcement of this statute has left trucking companies with two options to either install the B-type when driving through Confusion or elect not to install the hitch and drive around the state. According to the United States Constitution, Section 8, it states, Congress shall have power to regulate commerce with foreign nations, and among the several states, and with the Indian tribes. The enactment affects Tanya Trucker’s business by adding additional expenses to her company. Her intentions in filing a suit against Confusion may overturn the statute if the court renders favor on her behalf.

Tanya’s argument with the state of Confusion provides numerous conclusions for both parties. According to the United States Constitution, Article III, Section 2, The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, -to between a state and citizens of another state. Although this is a state issue, the federal jurisdiction still has the power to decide if this is a legitimate issue or not. According to Cheeseman (2010), State and local laws cannot unduly burden interstate commerce. Tanya has a valid argument with the additional costs imposed on her business along with other trucking companies who wish to travel on the highway running through Confusion....
