Tort Law and Defenses Involving BUGusa

BUGusa is a company based in Any State, U.S.A, which creates, builds, and sells recording devices to law enforcement agencies nationwide. Not only is the hardware manufactured by BUGusa, but also the software provided for each electronic device. Several scenarios including advertisement, competitors, stealing information, parking lots, equipment, and employee responsibility result with possible torts and defenses. In this paper, each scenario is identified and explained.

The first scenario is WIRETIME, Inc., a competitor of BUGusa, placed a competitive ad in a well-known magazine stating BUGusa electronic devices were not reliable and low quality. WIRETIME, Inc. carried out intentional business associated tort, also known as Defamation. As reviewing the case, all four factors of defamation are present, which include establishing a claim of intentional tort, defendant’s duty to the plaintiff, breach of that duty, which was the proximate cause of plaintiff’s injury and the resulting injury for which the plaintiff must be compensated. A defamatory claim was made, it was shown to a third party, the declaration was very particular to one organization, and it created harm to BUGusa clients.

The second scenario involves Janet, a BUGusa employee, and WIRETIME, Inc., WIRETIME, Inc. tried to convince Janet to come work for their company. Janet showed WIRETIME, Inc. a contract from BUGusa, that Janet was to not work for a competitor for 2 years; whether she quit or was fired. Janet decided to resign and work for WIRETIME, Inc. This scenario carried out a Tortuous Interference with Current Contractual Relationship Tort. WIRETIME, Inc. prompted Janet to break the present agreement with the BUGusa. WIRETIME had a unique understanding of it, and in fact saw the agreement. They unquestionably meddled with the agreement and created losses because of training, an alternative for Janet.
