Legal Risk and Opportunity in Employment

In reviewing the various legal encounters, there are multiple legal risks within each encounter. A legal risk is the possibility that an event will occur and the impact, the practical consequences, should that possibility comes to pass. (Compliance LLC, 2009) Legal risk is difficult to manage as there are vast arrays of circumstances and situations that can put one at risk. The best possible antidote in minimizing such risks is to assess the situation prior to acting. It is also important to consider the risks. In each encounter stated herein, there is a chance that due the handling of a particular situation the company, NewCorp, may suffer a substantial impact in the company; therefore putting the company at risk.

Two employees of the opposite sex enter into a consensual relationship. The male employee is the supervisor of the female employee. Later, the female employee decides to end the relationship. The male employee continues to pursue the female employee, even after he was requested to stop by the female employee. The female employee then decides to transfer from under the control of the male employee. The male employee intercepts the transfer and provides evidence that transfers to that particular department by females was hazardous to the health of their unborn children.

Liabilities

Sexual harassment is the proximate liability in this encounter. According to the Equal Employment Opportunity Commission, sexual harassment is unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature. Clearly this is a concern for NewCorp in that Sam, the male employee, continued to pursue Paula, the female employee, after she requested that he stop.
