The article that was chosen for review was by: BAILEY, KIMBERLY D.,
Journal of Criminal Law & Criminology, Fall2010, Vol. 100 Issue 4, pl1255-1300, 46p; LOST IN TRANSLATION: DOMESTIC VIOLENCE, “THE PERSONAL IS POLITICAL,” AND THE CRIMINAL JUSTICE SYSTEM.
This article affects the future of the criminal justice system because open
communication and exchanges are needed in order to address some of issues and concerns when it pertains to victim’s autonomy and most importantly, victims not wanting to engage with the criminal justice system.
This article is trying to get to the real issue at hand that involves victims of
domestic violence and the need for the criminal justice system to be more receptive to the
needs of these victims, and for the criminal justice system to accept some of the
accountability for being part of the reason for this disconnect.
The author’s conclusion is even though the victim autonomy was not the primary
objective of the criminal justice system, however, many should not be alarmed of the high percent of domestic victims that do not want to engage with the criminal justice system.
This is part of the metric used in determining the effectiveness of the criminal justice system. Also it was concluded that the criminal justice system is a limited tool in addressing concerns such as social, political, and economic problems.
I personally never dealt with domestic violence or know of anyone who have, but
upon reading the article I was in disbelief of how so many domestic victims do not want to engage with the criminal justice system. This can be seen as a real problem, and it would be very instrumental that changes be made so a happy medium can be reached. I am not saying that I agree, and I am not saying that I disagree with this article, but what I am saying is that this issue should not be taken lightly.
