Role and Functions of Law

In order for businesses to operate successfully in the modern society, law must be observed. Social behaviors must be regulated for the society to function in a smooth way. There are people who argue that common sense results into appropriate law. Whether this is true or not depends on how every individual understand the concept of law. Nonetheless, law constitutes regulations that ensure that common sense is observed. It also can be argued that law is simply imposed morals. There are various functions and roles of law in business and the general society. Law can simply be defined as the decrees of conduct of any systematized society whether major or minor, implemented by risk of penalty if not adhered to. The current law controls various divisions of conduct. Significantly, law entails conventions and rules that assist in administering conduct, managing misunderstandings, and tackling criminal offenses.

The functions of law in business and society can be categorized into three areas, namely,: criminal and civil law, substantial, and procedural law and private and public law (Bushman, 2007). Criminal law is where those members of the public that commit criminal offenses are put on trial by leading bodies. Civil law on the other hand, entails private entities filing lawsuits against each other for true or fake offenses. For instance, criminal law may apply in a case which an individual hits another with a car and civil law would tackle the court case in that the person injured may take legal action against the driver of the car so as to get financial compensation.
