Kudler Fine Foods Product Liability Overview

The responsibility of a manufacturer of vendor of goods to compensate for injury caused by defective merchandise that it has provided for sale (Farlex Inc., 2013). When individuals are harmed by an unsafe product, they may have a Cause of Action against the persons who designed, manufactured, sold, or furnished that product. The law has changed from caveat emptor (“let the buyer beware”) to Strict Liability for manufacturing defects that make a product unreasonably dangerous ("Product Liability", 2013).

Kudler fine foods being an upscale specialty food store that stores and stocks imported and domestic foodstuffs must be very careful to provide and ensure their customers the finest in selected foodstuffs, wines, and related needs (Apollo Group, 2013). Being an importer and domestic commercial purchaser and supplier, Kudler must have a strict regiment of product rotation and health related inspections. Kathy’s policy for inventory management must be equally strict to ensure that first product in is the first to leave inventory. This rotation method is called FIFO (first in first out).

Kathy Kudler’s policy on legal matters concerning the business is “come to me first”. Kathy is informed of any occurrence of a “slip and fall” incident, or any other legality relating to legal matters that occur in any of her stores. She uses her sister-in-laws law firm for legal council when needed, and pays $100 per hour for...
