Disadvantages to Foreign Businesses Conducting CIETAC Foreign-Related Arbitration in China

Abstract

This research essay looks at the disadvantages a foreign business will encounter when conducting foreign-related arbitration conducted by China International Economic and Trade Arbitration Center (CIETAC). CIETAC is one of the busiest arbitration institutions in the world, mainly dealing with cases between a Chinese Party and a foreign party. This research draws upon many sources, including legal commentaries and primary sources of law. Many foreign businesses are skeptical of the legal system in China in their ability to obtain justice. Through analyzing the legal terms of the arbitration law in China, this research will show that the law is not as unpredictable and suspicious as previously thought.
