Encounter 1

In this scenario, Pat Grey is a manager in NewCorp and he accepted a new job offer. He had to sell and buy a house about 300 miles away from his old home. Also, he had convinced his wife to quit her job to relocate his family. After 3 months later, Pat’s boss decides to fire him. Pat only gets 30 day severance pay and also, his boss just stated that it was not working out for him. Pat believes that senior management became unfriendly towards him after he made a comment about school fund at school. Pat has an advantage because NewCorp cannot fire him without giving him any feedback or warning about his performance. In NewCorp’s scenario it states that “If the job performance of an employee is unsatisfactory, the employee will be notified of the deficiency and placed on a Corrective Action Plan. If the employee performance does not improve to a satisfactory level within the specified period of time, termination will follow” (NewCorp Scenario, pg. 1 2010). I think Pat has a strong case in this situation because he could sue the company for disparate treatment under Title VII Civil Rights Act. “Title VII prohibits employers from treating applicants or employees differently because of their membership in a protected class.” (Wikipedia, 2010) NewCorp violates Title VII Civil Rights Act because of Pat’s comments he made at a school they try to discriminate against him.
