The Plaintiffs evidence for the Quid Pro Quo Case of Carry Newman vs. Rodger Fing stated that Newman had no previous relationship with Rodger and was in no way interested in going out with him. The plaintiff accused Rodger of sexual harassment because the second time he asked her out to the concert after she rejected him, he stated that “she would regret it if she refuses.” Rodger was known to have a reputation at work as being vengeful against co-workers if he did not get his way. While he was not Carry’s supervisor and had no power to directly affect her career status or advancement, Carry still felt threatened and nervous after his remarks towards her. Another big piece of evidence against Rodger was that he was not a fan of jazz music yet paid $500 for the concert tickets to take Carry to it. Rodger really went beyond usual means to get information about Carry and what her interest were so he could ask her out.

The defenses evidence that shows that Rodger was innocent was that a lot of people at work knew Carry was a Jazz fan and Rodger may have been told that Carry liked the artist playing at the concert. Carry revealed to the defense attorney that she would “regret” missing out on the concert as it was a rare appearance from the Jazz artist. Carry may have misunderstood Rodger when he stated that she would regret it if she refused to go by misinterpreting it as a potential threat against her career. One co-worker said that Rodger and Carry would make a cute couple and he should ask her out.

My decision on this case is that Rodger is innocent on the accusation that he sexually harassed Carry and in no way was a threat to her career or advancement at work. Carry was actually promoted and awarded after the second time he asked her out which counters her original accusation that he would be a problem for her.
