Contract Creation and Management Simulation

The contract creation and management simulation focused on several issues and concerns. The simulation focused on legal issues and principles related to contract creation and management. This paper will answer several questions that arose from the simulation, including how the formation was achieved, how the contract should have been administered, methods for dispute resolution and what decisions could have been made differently, if any.

When completing the simulation several issues were realized. The initial question raised was how the contract formation was achieved. The simulation does not clearly define how the original contract between PM Spans Systems and Citizen Schwartz was original established, but given that there are numerous issues from the original contract being questioned it is fair to say that the contract language was very vague. As the simulation continued it was clear to me that there was a legally enforceable contract, which is “A contract in which if one party fails to perform as promised, the other party can use the court system to enforce the contract and recover damages or other remedy, previously in place (Cheeseman, 2010). Additionally, the three areas of focus on from the original contract subsequently causing creation of an amended contract we breaching of the original contract on the basis of underperformance, requirement changes and failure to follow the escalation provisions. Once these areas of breaching were identified measures of creating an amended contract were then put forth. This eventually culminated in achieving agreed upon contract clauses that both parties were satisfied with.

As the simulation carried out the administration of the contract needed to be reviewed. It was clear that up until the point of the concerns and threats of breach of contract little to no administration of the contract had occurred. Neither party, Spans Systems or Citizen Schwartz really had...
