A Bill For An Act Entitled: Children On Trucks

In the Senate

Senators Albert P. Franco and Nadine P. Osorio introduced the following resolution which was referred to the Committee on Child Safety.

Senate Proposal

Resolved by the Senate of the Republic of the Philippines, that the following article is proposed as federal law under the jurisdiction of the Republic of the Philippines, enforceable by Executive action.

"Be it enacted by the Senate and House of Representatives of the Republic of the Philippines in Congress assembled, that children below the age of 18 are not allowed to ride the back of an open-top rear cargo utility vehicles:"

Section 1: Explanation of terminology

• Children – any person regardless of race of nationality below the legal age of 18

• Open-top rear cargo utility vehicle

o Pick-up trucks

o Open Elf Trucks

o Open-Top Delivery Trucks

Section 2: This act will prohibit children below the age of 18 from riding the rear end of open-top rear cargo utility vehicles. This act was brought about by accidents brought about by children falling off the rear cargo area of these utility vehicles. This will impact and involve the local police and MMDA enforcers

Section 3: This act will be enforced through-out the Philippines’ area of responsibility

Section 4: Funding for this act will be sourced from the local government’s budget as part of the budget of the executive branch of the government

Section 5: Penalties for non-compliance of the act shall be suspension of the license of the vehicle’s driver for no less than (1) one month, but not more than (6) six months; with a corresponding fine of no less than (P1,000.00) one thousand pesos, but not more than (P6,000.00) six thousand pesos.
