Golf Accident

During a round of golf a refreshment cart driver accidently hit into a threesomes cart parked near the ninth green of the course. The two carts’ bumpers were locked together and the girl driving panicked and started to cry. One of the golfers named Bill asked to help and got in the cart to drive. When Bill tried driving the cart he flipped it spilled the contents of the cart and suffered an injury on his forehead requiring medical attention. In this case there is only one solution to the problem of who should be held liable.

Whenever the girl locked the carts together she would be held liable for the damages of the carts bumpers. However whenever Bill offered to help her and got into the cart and ended up flipping the cart and causing more damage and hurting himself he became the liable person for paying the damages. If this case were taken to court Bill would be held responsible for the damages to the cart. Bill should have left the carts alone and the girl should have gotten out of the cart and called for help from the maintenance or cart house workers. Instead of doing this Bill made the situation worse and is now liable for the damages.

If the golf course would decide to press charges for the damages then Bill would be held liable for damages to the cart after he flipped it, he would be liable for the drinks he destroyed and he would also have to pay for his own medical bills for the thirteen stiches on his forehead. However if the golf course would not press charges then Bill would only be responsible for his own medical bills for his stitches. Bill would not be considered a criminal because this was an unintentional accident. He would be civilly liable.

The refreshment cart girl is ethically inclined to help Bill pay for anything he is liable for even his medical bills. The girl was the one who locked together the carts and Bill was just trying to be nice and help. She should...
