FOOD SAFETY ACT 1990

The Food Safety Act 1990 is an Act of the Parliament of the United Kingdom. It is the statutory obligation to treat food intended for human consumption in a controlled and managed way.

The key requirements of the Act are that food must comply with food safety requirements, must be "of the nature, substance and quality demanded", and must be correctly described (labelled).

Advertisement includes any notice, circular, label, wrapping, invoice or other document or presentation, and any broadcast or public announcement by visual or acoustic presentation or both, and "to advertise" shall be construed accordingly; this is the definition

Authorised technique shall not include any technique which involves no more than, or no more than the assistance of, naturally occurring processes of reproduction, including selective breeding techniques or in vitrio fertilisation;

Authorised officer means any person suitably qualified to the satisfaction of the health authority; "but if regulations made by the Ministers so provide, no person shall be so authorised unless he has such qualifications as may be prescribed by the regulations.

Authorised place means any port, airport or other place authorised by or under the regulations which is used, or is capable of being used, for the importation or exportation of food or food sources, and, in relation to food in a particular consignment

Food safety

If your business deals in food you must:

• Make sure food is safe to eat

• Make sure you don’t add, remove or treat food in a way that makes it harmful to eat

• Make sure the food is the same quality that you say it is

• Make sure you don’t mislead people by the way food is labelled, advertised or marketed

• Keep records on where you got food from and show this information on demand - known as ‘traceability’ (PDF, 86KB)

• Withdraw unsafe food and complete an incident report

• Tell people why food has been withdrawn or recalled, eg a leaflet or poster
