Operating legal environment is very important today. People need to know the different legal operatives in a common use so that they can effectively perform their legal obligations to fill satisfaction of not only the organization but also to the empowerment of their employees and colleagues.

A common law the body of law developed from custom or judicial decisions in English and U.S. courts, not attributable to a legislature. It is the law which is generally practiced on this basis of very many judgments given in similar cases. HR managers need to know what the common law is and how it is applicable in the hiring and dismissal process. What the legal remedies that are available in employee cases with references to specific instances and how they can be applied is called the legal expertise. HR managers commonly refer to the common law that can be practices similar, also known as law or precedent, the common law is that law in practice on which certain very important decision have been made and the courts follow the decision given in the prior case. This principal is called the principal of Stare Decisis. Common law is created by precedents and hence it is easy for courts to follow the decision made in prior cases. Every state has an area of jurisdiction and common law is bound by that jurisdiction hence common law differs from state to state. The constant principle rules need to be applied while deciding on the nature of law and generally common law is the law that is generally accepted as a practice.

The American law has been formed after a series of different concept of common law and rules American law is not a single law but emanates from many sources. The common law is found in the decision given by courts rather than by statues, the statuary law where the legislature form laws.
