LIT1 Task 2

In this essay we will explore three different situations that can occur in a company atmosphere. We will discuss how the Family and Medical Leave Act of 1993, Age Discrimination in Employment Act of 1967, and the Americans with Disabilities Act of 1990 apply to each given situation. All of these employment laws were put into effect to protect American citizens in the work force in various ways. An example for each act would be: an employee that has a baby or becomes very ill should not have to worry that they will lose their job due to this life changing event, or a person that is 55 years old has just as much right to work as a person that is 25 years old, and last but not least a person with a disability whether it be from serving in the military, a birth defect, or an accident etc. that person still has just as many rights to work as anyone else. We will get into these laws more in depth as we go.

In the given situation A, employee A has been working with Company X for two years and his spouse just had given birth to twins prematurely. The employee requested to take an 11 week leave of absence under the Family Medical Leave Act of 1993 (FMLA). Employee A was granted the option to take the 11 week leave of absence for the birth and caring of his premature baby twins. When he was ready to come back to work, the company allowed for him to return to work at his previous position and at his previous rate of pay. The employee also put in a request for the 11 weeks of withheld pay which was denied by the current manager. In this case, Employee A is in need of the coverage of the Family Medical Leave Act of 1993 or FMLA in order to ensure his position will not be filled during his time away. FMLA is a type of benefit coverage that employees can take advantage of if something happens in their personal life like the birth of a child, if the employee falls ill or someone in the employee’s family becomes ill and needs the employee there to help take...
