Inheritance in islam

Inheritance is an involuntary devolution of property which the estate of a deceased person is transferred to the heirs as his/her successors.

Here I will like to demonstrate an example of the execution of inheritance with regard to my family. First by making assumption that the deceased is my father, we must first look the heirs that my father will left behind after he passes away. If my father passes away, according to currently heirs, my father will left behind a wife, a son, a daughter, a father, a mother, 3 full brothers, and 3 full sisters.

Because of the presence of son, that is me, all collaterals which is my father’s full brothers and full sisters will be excluded. So, the only heirs that will inherit from my father are the wife, my fathers’s father and mother, and all my father’s children.

My father’s father will inherit 1/6 of my fathers estate. My father’s mother will also inherit 1/6 of my fathers estate. Initially, she inherits 1/3 but she is partially excluded by the presence of my fathers children. As for my mother, my father’s wife, she will inherit 1/8 of my father’s possession. This is because with the presence of my father’s children, she is partially excluded from the initial shares that is 1/4. As for my father’s children, myself and my sister, we inherit as residuaries/`asabah. The distributions among the daughter and son is following the principles of 2 shares for a son and 1 shares for a daughter. All these calculated shares is being shown in the table at the next page.
