The Americans with Disabilities Act of 1990 (ADA) makes it illegal to discriminate in employment against a competent individual with a disability. The ADA also prohibits discrimination against individuals with disabilities in State and local government services, communal accommodations, transport and communications. The purposefulness of this law is to prevent discrimination in the work place and to provide equal employment opportunities for individuals live with disabilities or have had records of disabilities.
The description of an individual who has a disability is a person who:
* Has a physical or mental deficiency that significantly bounds one or more main life actions;
* Has documentation of such an deficiency; or
* Is considered as having such deficiency.
Employers covered by the ADA have to make sure people with disabilities:
* Have an equal prospect to apply for jobs and to labor in jobs for which they are competent;
* Have an equal opportunity to be sponsored for promotions;
* Have equal admission to profits and rights of employment that are obtainable by other employees; and
* Are not stressed because of their infirmity.
Further, an employer is also required to offer a rational adjustment if a person with a disability needs one in order to apply for a job, accomplish a job, or relish profits equal to those presented or obtainable to other employees. An employer however does not have to oblige any accommodation that would trigger an undue hardship.
