Court History and Purpose Paper

In this paper I will be discussing what a court and its purpose are. I will also be giving details about a dual court system as well as describing the roles of early legal codes, common law, and also precedent that was played in the development of the court system. Last, I will identify the role of courts in the criminal justice system as we know it today.

Human condition is what impartial and independent judiciary stems its roots from. As we are all aware, most things in life tend to be not as fair as we would like them to be. Even corporate offices and government officials stir up conflicts by not doing the right thing like they should. Even with the thought of doing something right or legal, there is always the chance of being incorrect. In order to arrive at the goal of achieving impartiality and to gain independence, society can be somewhat of a complex situation to deal with. Courts are in charge of reinforcing all kinds of authority over the state as well as protecting individual people against the arbitrary usage of government’s powers. There is a lot of tension between social order and an individual’s freedom. It is a good thing that the majority of court leaders are well aware that there is rarely only one way to proceed with a case. There are usually several instead. With that being said, court leaders also are respectful of all of the other branches in the justice system as well as the people who lead each branch. The reason for this is because each branch of the system is responsible for itself, but each branch works as a checks and balance system for the other branches and also its own branch ("Chapter 2 The Criminal Justice System", 2000).
