Functions and Role of Law in Business and Society

Every day the law is being obeyed by most whether a business or a citizen, these laws are put into place for our protection and discipline as people and the rights we have based on the U.S. Constitution and the Bill of Rights. It is the same for businesses. These laws also can help and hurt businesses in this paper we will take a look as to why, why they can hurt us and why they can help us.

Laws and Rights

The main reason for these laws and rules is to protect, protect businesses, for a citizen to be protected from a criminal, and also to protect the people’s rights as American citizens. From a business stand point why do we need these rules and laws? Is it protection for the business? Is it protection for the consumer? Or is it both?

Both sectors of this subject have protection in our judicial system; they are protected under the rights of the U.S. Constitution. In the application of Commerce Powers, congress will exercise its commerce powers in various forms. However, the direct and broad power to regulate all persons and products related to the flow of interstate commerce is the fundamental source of its authority (Melvin, 2011).

Protection by the rights of the constitution and having these laws and regulations create checks and balances in the world of consumer and business in society. As an example is the case of Cipollone v. Liggett Group, Inc. Cipollone sued Liggett for violation of New Jersey consumer protection statues alleging that Liggett were liable for his mother’s death because of such items as false advertising, fraudulently misrepresenting the hazards of smoking, and conspiracy to deprive the public of medical and scientific information about smoking.
