WRITING TASK 2

Deciding which punishment is more appropriate for each type of crime has always been very difficult for those who establish the laws.

Fixed punishments seem to be the most effective solution, because it does not allow endless postponements of the sentence. Sometimes, in fact, offenders do not pay for their crimes because of the time of justice, which provides for the fall in the prescription of the judgment after a certain period, depending on the cases. Therefore, having a defined punishment enable justices to do their job quickly avoiding unnecessary disputes.

However, every civilized country, should have established in their laws, the right of a human to defend him-herself against any kind of allegations. “Innocent until proven guilty” we usually say, meaning with this sentence that everybody must have the opportunity to present his version of the events. With or without the presence of a lawyer, an individual has the right to argue the circumstances that involved him/her and even explain, in case of guiltiness, the motivations that pushed him to commit the crime.

Unfortunately, the system of justice does not work in the same way in every country, starting from how laws are applied during a court case. In Italy, for example, judges strictly follow the laws for a verdict, whereas in America they usually base their decision on previous similar cases. While in Italy each case is different from the other and needs to be evaluated independently from analogue cases, in America the first case creates a precedent, thus all the following cases must refer to it.

In my opinion, Italian judgment system is impartial, and that is why I prefer it respect to the American one. Nevertheless, I firmly believe that a judge should analyse the type of the case and the accused before deciding his verdict. A young individual, in fact, could easily make mistakes due to his age or maybe his history and he should learn the lesson with social services instead of...
