The National Labor Relations Act, NLRA, of 1935 “protect[s] the rights of employees and employers, to encourage collective bargaining, and to curtail certain private sector labor and management practices, which can harm the general welfare of workers, businesses and the U.S. economy. (Sec. 7. [§ 157.] Employees shall have the right to self-organization, to form, join, or assist labor organizations, to bargain collectively through representatives of their own choosing, and to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection, and shall also have the right to refrain from any or all of such activities except to the extent that such right may be affected by an agreement requiring membership in a labor organization as a condition of employment”.http://www.nlrb.gov/resources/national-labor-relations-act). This law allows unions to form and employees to strike should an employer have unfair working conditions.

NLRA protects those in a union, but not the typical employee. The typical employee is left to their own devices to negotiate pay and working conditions, and if the employer chooses they can terminate the employee. Under the NLRA an employer who “refuses[s] to bargain collectively with the representatives of his employees” grants the employee the right to strike. A typical employee does not have that right; they can either attempt to negotiate pay, keep the same pay, or find a new employer with better pay.
