Introduction

Many disputes on the state level can be solved in court. Depending on how severe the dispute is the dispute could go as far to reach the Supreme Court on appeal. A route that is more practical would be for the business to remain in their general jurisdiction or to use alternative dispute resolution (ADR) methods.

Case scenario

The owner for an authorized shipping center for several years has been able to maintain his contract with his copying equipment supplier. The business is billed for services on a monthly basis this includes equipment use and maintenance. The business also is billed on a monthly basis for prints that are made. A dispute arose after a routine maintenance check was performed during the check the technician noticed an ink cartridge issue an advised the business owner. The technician told the owner to expect the new cartridges within the week. The business however did not get the new cartridges until a month later. While the business was without the ink cartridges they were unable to print out anything which resulted in a revenue loss for the business. Regardless the business still received their monthly bill and were charged for their allotted print total. The business owner immediately contacted his supplier but the issue was not resolved.

The court proceeding

Resolving disputes in court can be time consuming and costly and result in possible damage to the business. All parties who are involved must follow filing procedures and possibly hire an attorney. Convenience is also another issue the parties are at the court’s mercy in regard to location and scheduling. This can result in a high stressed situation and a possible business relationship dissolution. In this case it would be more beneficial to preserve the relationship.
