Case Brief: Parker V. State

The issue in the Parker v. State case was Mr. Parker was convicted of first degree murder, armed robbery, and aggravated battery in the robbery of pizza hut in Pompano Beach in 1989. Mr. Parker was sentence to death. Mr. Parker tried on several occasions to appeal his case. Mr. Parker appealed his case on direct appeal 16 times and all 16 times the court found the claims to be without merit, not properly preserved for appellate review, or harmless beyond a reasonable doubt. The rules in this case was by it going forth before the court on appeal it was denied under a motion to vacate judgment of a conviction of first degree murder and he was sentence to death under Florida law and criminal procedure 3.851. The analysis of this case was Mr. Parker was not a first time offender that’s another reason his case was affected. His other charges include a conviction of a violent felon. Parker also created a great risk of death to many people. Parker also committed this murder right after he was committed in another robbery. Parker even murder the people to prevent and avoid arrest. The judge also decided that they found no statutory or non-statutory circumstances had been established. In conclusion, the case was affirm in part and reverse in part of the trial court’s order denying post-conviction relief. The case was remand for a new penalty phase proceeding before a jury.
