Probation is used to describe a period before an offender is actually sent to jail or prison. When a defendant is granted probation, the judge gives him or her opportunity to show the desire to rehabilitate. In this case, the defendant is given probation without a pre-determined sentence. On the other hand, parole is the period after a defendant is freed from prison. Some of the conditions associated with parole require the defendant to continue meeting financial obligations while staying in a halfway house. The functions of parole and probation tend to be similar in the sense that both are focus on helping the defendant to cease from the bad behaviors or habits that caused them to go against the law. Despite the fact that both have a strong rehabilitation component, each process utilizes additional goal of providing protection to community members (Cole, Smith & DeJong, 2014). The murder case involving Troy Davis has been used in this analysis to increase the general understanding on probation and parole. Specifically, the analysis provides a brief biography about Troy Davis, provides an overview of crime and the court case, discusses the appeal process, and identifies the role of the Georgia Parole Board.  

Part I: Biography about Troy Davis and Family Information

Troy Anthony Davis was an American citizen born in October 9, 1968. He was the first child of Joseph Davis, a Korean War veteran Joseph and Virginia Davis. The couple parted ways when Davis was still young. He lived in the predominantly black neighborhood of Cloverdale located in Savannah, Georgia. A few years after joining Windsor Forest High School, he dropped out of school so that he could take care of his disabled younger sister.
