Introduction

The critical thinking is the ability to focus on the quality of someone’s reasoning. According to Kubasek (2009), it can be understanding the arguments, ability to evaluate a criteria, and assess the quality of the reasoning. In the research, there is a demand for better critical thinking skills. In this article, the author elaborates the eight steps of a critical thinking approach to legal reasoning in the global business environment. The legal environment of business demands for critical thinking skills due to competition, business ethics while understanding the law. In this article, the author explains the implication of a multinational organization that chooses to be held accountable only for adhering to the letter of the law compared to an organization conducting its operation within the ethical norms. The author here analyzes Kubasek et. Al text for the critical thinking approach to legal reasoning.

1. What are the facts ?

Kubasek et al (2009), suggests that in critical thinking one should first look for the most basic building blocks in a legal decision or arguments. In this context the facts are detailed as below,

A multinational organization chooses to be held accountable only for adhering to the letter of the law.

A multinational organization chooses not to be held accountable for conducting its operations within international and domestic ethical norms.

Once all of the facts are known, the issue must be determined. According to Atkinson, K. (2005), legal reasoning begins with facts and ends with legal conclusion, the law is typically stated in terms which cannot be directly equated with the facts.
