Metro Corporation Case

The Facts:

This case is with regards to an annual strategic planning meeting of the Metro Corporation, comprising of fourteen members of the Executive Management Team, held in Miami, Florida. The team comprised of only three female executives and the rest were males including the CEO and CFO. The meeting was a four day session and it was customary for the team to go out to dinner together at an expensive restaurant which ended with heavy consumption of alcohol. After the dinner the CEO suggested to the group to continue the evening at the Cheetah Lounge Strip Club and also informed them that it was ok if anyone wanted to opt out of going, but he said that with a bit of sarcasm, trying to imply that he wouldn’t be very happy about it and actually wanted all of them to join. Two women from the team out of which one was a new employee, opted out and wanted to go back to their hotel, on which the CEO touched the shoulder and expressed his disappointment to the new female executive and said that he would encourage her to become more open minded and mature in the future. Once the team was back in town and during a subsequent meeting, the members who attended the strip club recalled the good time they had during their exploits on the last day of their trip. As I am a part of the human resources department, one of the female executives who did not go to the club during their four day trip to Miami, comes to my office and shares all the facts that she knows including the fact that the clubbing was going on for many years, and demanded action by putting an end to it and also expected the conduct of the CEO to be brought to the Board.

The Issues:

This complaint seems like a case of hostile work environment. Based on the facts of the complaint, it has to be first established if this case legally constitutes a case of hostile work environment.
