Definition

Negligent hiring happens when an employer ends up hiring a new employee either without doing a background checks on that employee or by just ignoring a criminal background. Hiring an employee with a criminal background who you are putting into customers’ homes or giving access to private customer information leaves you up to negligent hiring. Negligent hiring doesn’t end with the hiring process of an employee is over. Negligent hiring can happen by retention of an employee with criminal background as well. In order for an employer to be charged with negligent hiring it needs to be proven that the employer knew about the employees’ criminal background before hiring them.

Negligent hiring doesn’t just have to be done with a person with a criminal background it can be if you hire an employee who could pose a threat to others, either co-workers or customers. If you would have any reason to believe that an employee you hire could be dangerous to themselves or others while in your work department you could be hit with negligent hiring. You could find these things out if you were to notice something while interviewing or by reading their resume and/or cover letter. You could get told by other workers or clients about the behavior of the employee that if you choose to ignore would leave you open to being charged with negligent hiring or negligent retention, which is the same thing but that you keep the employee on payroll.
