1.1 Issue

The issue here is the offences Zhang, Wang and Chang committed under the Singapore law. They were disgruntled with their working hours and salaries which lead to a strike. They are the key instigators behind the illegal strike, in an effort to make the authorities succumb to their demands, the china-based workers threaten with bodily harm to get the other train drivers from Philippines and India to join. All of which led to the three being charged in court and the other drivers who partake in the strike being deported back to their countries.

1.2 Rule of law

In this case, a strike in the public transport services, provided by Singapore Mass Rapid Transit (SMRT) Corporation are listed under “disruption of essential services” under the Criminal Law (Temporary Provisions) Act (Cap 67). An Act to make temporary provisions for the maintenance of public order, the control of supplies by sea to Singapore, and the prevention of strikes and lock-outs in essential services. (MOM,2012)2. Under the Singapore law, all strikes are stipulated as illegal for workers in essential services mainly in areas on healthcare and public transport sectors unless they give employers 14 days’ of notice of the intent to go on strike and comply with the requirements of the notice.

1.3 Application of law to the fact

With application to the law stated above, this defines the rules and terms of workers doing essential services to follow including the rules stipulated in the trades unions acts and trade disputes act which includes public bus and air transport workers which made the list in 1967.

Firstly, when Zhang, Wang and Chang signed the employment contract of agreement, they would be held liable for any refusal to report for work despite negotiation attempts by SMRT representatives.
