When it comes to organic produce, liability and regulatory implications are of question. Organic produce is free from preservatives which are added to help prevent spoilage during transport. These preservatives serve as antimicrobials or antioxidants. It helps to keep the food from developing brown spots or even mold.

With organic foods, they’re grown without pesticides, and the fertilizer is made with synthetic ingredients, or sewage sludge, bioengineering, or ionizing radiation. Before a product is labeled “organic”, a government approved certifier inspects the farm where the food is grown to make sure the farmer meets the U.S. Department of Agriculture’s organic standard. Companies that handle or process organic food before it reaches the supermarket or restaurant must be certified too (http://www.fda.gov/Food/ResourcesForYou/Consumers/ucm114299.htm).

Product liability insurance protects the business from claims related to the manufacture or sale of products, food, medicine, or other goods to the public. It covers the manufacturer’s or seller’s liability for losses or injuries to a buyer, user or bystander caused by a defect or malfunction of the product, and , in some instances, a defective design or a failure to warn. When it is part of a commercial general liability policy, the coverage is sometimes called products-completed operations insurance (Boop, 2010).
