Yes, the company used an intentional business-related tort: defamation. By placing an ad against the other company, BUGusa, stating that their product is low in quality. Defamation is stating a false statement that concerns the other party’s reputation.

Scenario: WIRETIME, Inc. (Janet)

Has WIRETIME, Inc. committed any torts? If so, explain.

Yes, Janet has committed a tortious interference. Tortious interference is a tort where one holds a legal contract with one party and breaks the contract by going against it. By taking the offer from WIRETIME, Inc. after it was stated in her contract with BUGUSA, which she will not work for the competitor during her employment.

Scenario: WIRETIME, Inc. (Steve and Walter)

Discuss any liability BUGusa, Inc. may have for Walter’s actions.

I believe he did. I would say he had committed and intentional infliction of emotional distress. Walter threating Steve that he would hurt him if he did not fess up if he has been providing information to WIRETIME is a form of tort. As for liabilities, if Steve was to report the harassment to HR, then BUGusa would be losing time and money on a complaint, but then it would mean that Steve’s cover could get blown and put WAIRETIME in a harder situation.

What defenses may be available to BUGusa, Inc.? Explain your answer.
