Mary Jo works in one of Global Power Tools’ factories. She is a member of the union and has come to the union for help. According to Mary Jo, she told her supervisor, Jane Smith, that she was depressed and needed to adjust her work schedule because she was experiencing financial difficulties and was going to start working a part-time job. Later, Mary Jo overheard her supervisor complaining to Henry, a fellow co-worker, about Mary Jo’s request to change her schedule. Mary Jo even heard her supervisor say that Mary Jo was a “mental case”.

The National Labor Relations Act of 1935 (49 Stat. 449) 29 U.S.C. § 151–169 (also known as the Wagner Act after NY Senator Robert F. Wagner) is a foundational statute of US labor law which guarantees rights of private sector employees to organize into labor unions, engage in collective bargaining for better terms and conditions at work, and take collective action including strike when necessary. A labor union is defined as an organization of workers who have come together to achieve common goals such as protecting the integrity of its trade, improving safety standards, achieving higher pay and benefits such as health care and retirement, increasing the number of employees an employer assigns to complete the work, and better working conditions. The trade union, through its leadership, bargains with the employer on behalf of union members (rank and file members) and negotiates labor contracts (collective bargaining) with employers. The most common purpose of these associations or unions is to maintain or improve the conditions of their employment.
