TROUBLE

Some juveniles are just TROUBLE! They don’t understand that what they do does have consequences and that they will go to jail if the offense is bad enough they can be charged as an adult. Without the support and love of a family many juveniles seem to act out to get attention, but many go too far like John. John has created a scenario because he brought a gun to school and stated that he was intending to use the gun on some bullies. I will be talking with you about his due process, search and seizure, interrogation, and five other court cases in history that changed the juvenile system.

When it comes to the due process the police wait for a parent or lawyer to arrive before they can ask any questions or place him under arrest. He has to be put in a place that does not intimidate him. Once the guardian arrives he is read his rights and told his charges before took to a juvenile detention. He will stay in the detention until his court date because of the charges is so bad. He stated that he was going to use the gun on others.

When it comes to the search and seizure process they have the right to search his locker without a search warrant because it was told that he had a gun in his locker. When they here of something like this they do not have to wait on a warrant because to many lives are at stack. The police need to be there so that they can take the gun into evidence and make sure that it is properly handled right. You lose your right to a warrant when it is in a public school and I think that it should be that way due to all of the school shootings today.

There have been five major cases in history that has changed the juvenile court systems. The first is Kent v. United States 1966. The court decided that all courts must provide the essentials of due process when a juvenile is transferred into adult court. Kent’s...
